Nexium Settlements

Nexium lawsuits involving the heartburn medication’s alleged association with kidney failure, chronic kidney disease and other renal complications are beginning to mount in courts throughout the U.S. While it is too early to predict if any of these cases will result in Nexium settlements, any such agreements could provide patients with compensation to cover medical bills and other damages related to their alleged injuries.

Nexium Kidney Litigation

Nexium belongs to a class of heartburn medications called proton pump inhibitors. Every year, millions of Americans use prescription and over-the-counter proton pump inhibitors to treat GERD and other problems related to the excess production of stomach acid. Because these drugs are so commonplace, most patients never give a thought to their safety. However, recent studies have linked the long term use of proton pump inhibitors to a wide range of serious side effect, including potentially life-threatening kidney complications. These studies have sparked numerous lawsuits that accuse AstraZeneca of concealing information suggesting that Nexium could harm the kidneys.

The kidney litigation involving Nexium and other proton pump inhibitors is only in its earliest stages. Plaintiffs are currently seeking to have all such federal lawsuits centralized in a single U.S. District Court for the purposes of coordinated pretrial proceedings. The U.S. Judicial Panel on Multidistrict Litigation (JPML) will hear Oral Arguments on the matter during a hearing scheduled for January 26, 2017.

If these cases are centralized, a single U.S. District Judge would preside over all pending lawsuits, as well as any filed in federal courts in the future. The docket will undergo coordinated discovery and motion practice, and eventually several representative Nexium lawsuits will be selected for bellwether trials. Verdicts in these cases often provide insight into how juries might rule in similar claims. Though it is impossible to predict if  the  multidistrict litigation process will result in any Nexium settlements, these types of centralized proceedings often do provide a pathway to resolution.

Am I Eligible to Participate in a Nexium Settlement

There is no guarantee that any Nexium lawsuit will end in settlement. However, you could be eligible for compensation if you were treated with this proton pump inhibitor and developed any of the following renal complications:

  • Acute interstitial nephritis
  • Acute kidney injury
  • Chronic kidney disease
  • Kidney failure

Plaintiffs who benefit from a future Nexium settlement could receive compensation for many of their injury related damages, including:

  • Medical bills
  • Lost wages
  • Permanent disability
  • Pain and suffering
  • Emotional distress
  • Wrongful death for those who lost a loved one due to kidney complications

Bernstein Liebhard LLP offers free, no-obligation legal reviews to individuals who were diagnosed with chronic kidney disease, renal failure and other kidney complications after taking Nexium.
