Breaking News: Nexium Litigation Updates

• October 2016: Nexium plaintiffs and others who allegedly suffered serious kidney injuries related to the use of a prescription or over-the-counter proton pump inhibitor are seeking to have all  federally-filed  claims centralized before a single judge in the U.S. District Court, Middle District of Louisiana.  According to a Motion for Transfer filed with the U.S. Judicial Panel for Multidistrict Litigation (JPML) on October 17^th, at least 15 such lawsuits involving Nexium and other heartburn medications in this class are already pending in federal courts around the U.S. However, plaintiffs assert that the litigation will eventually grow to include hundreds of similar claims. • January 2017: The JPML has denied a request by proton pump inhibitor plaintiffs to centralize all federal kidney injury claims in a single jurisdiction. In an Order issued on February 2, 2017, the Panel said a number of factors drove its decision, including the differing heartburn drugs involved in the litigation, as well as the need to protect trade secrets among the various defendants. August 2016: Bernstein Liebhard LLP has filed a Nexium lawsuit on behalf of an Illinois resident who allegedly developed kidney disease due to his use of the “little purple pill.” The complaint, which is currently pending in the U.S. District Court, Eastern District of New York, accuses the drug’s manufacturers of failing to warn patients of the purported link between Nexium and serious kidney injuries. Nexium Lawsuits Mounting in U.S. Courts

• November 2016: Several proton pump inhibitor manufacturers filed responses with the JPML in opposition to a motion seeking centralization of all federally-filed kidney injury cases in a single U.S. District Court.  AstraZeneca, the manufacturer of Nexium, argued that the variety of injuries alleged in the lawsuits, the large number of proton pump inhibitors currently on the market, and the potential for the litigation to involve more than 60 defendants makes the docket unfit for centralization. • November 2016: One stock analyst is speculating that the growing litigation involving Nexium and kidney injuries could eventually affect sales of the drug. • June 2016: A proton pump inhibitor lawsuit has been filed in the U.S. District Court, Eastern District of New York, on behalf of a Plaintiff who suffered acute kidney injury allegedly related to his long-term use of Nexium and PrevAcid. The complaint claims that the manufacturer of Nexium received numerous case reports of kidney injuries in patients that had ingested the drug as early as 2004. • May 2016:  A Nexium lawsuit has been filed in the U.S. District Court, Southern District of Illinois, by a kidney transplant patient who alleges that the proton pump inhibitor caused him to develop  chronic kidney disease that ultimately progressed to renal failure. The complaint further asserts that AstraZeneca had received numerous case reports of kidney injuries in patients that had used Nexium as early as 2004, but continued to aggressively market the medication without providing appropriate warnings to patients and doctors. Nexium and Heart Attacks

In June 2015, research published in PLOS One indicated that patients who used Nexium and other PPIs were 16 to 21% more likely to suffer myocardial infarction, commonly known as a heart attack. The research found that the drugs doubled the risk of cardiovascular death. A similar increase was not found among patients who used H2 blockers, another class of heart burn medications that includes Zantac, Tagament and Pepcid.

The PLOS One study involved an analysis of medical records from 2.9 million patients. The authors of the research asserted that their findings, while not proof of a causal relationship between PPIs and heart attacks, warranted greater discussion. Read More

Nexium Lawsuit for Stomach Cancer

A recent study suggests that filing a Nexium lawsuit could be a possibility for those who developed stomach cancer following long-term proton pump inhibitor use.

Writing in the September 2017 issue of  Gut, a group of researchers from Hong Kong noted that a bacterium called H. pylori (best-known for its link to gastric ulcers) is a known risk factor for stomach cancer. But even when treatment has successfully eradicated the bacterium, stomach cancer may still occur.

To investigate why this was the case, the research team studied 63,397 people who were successfully treated for H. pylori infection, including 3,271 who used Nexium or another proton pump inhibitor and 21,179 who took an H2-blocker (such as Zantac or Pepcid). During average follow-up of 7.5 years, 153 of those patients developed stomach cancer.

Compared to those who took H2 blockers, patients who used proton pump inhibitors were twice as likely to develop gastric cancer.

The risk increased with extended proton pump inhibitor treatment:

• Those who used the drugs daily were more than four times more likely to develop stomach cancer compared to those who only used proton pump inhibitors once per week.
• Patients who took proton pump inhibitors for a year were five times more likely to develop stomach cancer.
• Taking a drug like Nexium for two years or more increased the likelihood of gastric cancer by more than six-fold.
• The risk of stomach cancer rose more than eight times when proton pump inhibitors were used for three years or more.

Nexium and Kidney Problems

In 2016, a study published in JAMA: Internal Medicine suggested that patents who took PPIs twice a day were 46% more likely to develop Chronic Kidney Diseae, or CKD. Those who used a PPI once per day had a 15% higher risk. The study drew data from 10,500 patients who had been treated with the medications between 1996 and 2015. Read More

CKD is a serious condition that has the potential to cause kidney failure. Symptoms may include:

• Fatigue, lack of energy
• Difficulty concentrating
• Poor appetite
• Trouble Sleeping
• Muscle cramping that occurs at night
• Swollen feet and ankles
• Puffiness around your eyes, especially in the morning
• Dry, itchy skin
• Need to urinate more often, especially at night

In 2014, the FDA updated the labels for Nexium and other PPIs to include information about nephritis, an inflammation of the kidneys that can also lead to kidney failure. Nephritis can cause the following symptoms:

• Blood in the urine
• Fever
• Changes in urine output
• Drowsiness or confusion
• Nausea, vomiting
• Rash
• Swelling of the body
• Weight gain from fluid-retention
